A Michigan law effective July 1, 2024 requires a Power of Attorney to contain an Agent’s Acknowledgment section where your named agents sign agreeing to their responsibilities, and the limitations on their authority. Although the new law did not void pre-existing Powers of Attorney, it does mandate that before exercising authority under a durable power of attorney an agent shall execute an acknowledgment of the agent’s duties. (Note, the Agent’s Acknowledgment replaces the Acknowledgment of Responsibilities required by a previous law)
A Power of Attorney prepared before the new law became effective can be updated by attaching an Agent’s Acknowledgment that is then dated and signed by each of your agents..
