A Michigan law that was effective October 1, 2012 requires a Power of Attorney to contain an Acknowledgment of Responsibilities section where your named agents sign agreeing to their responsibilities, and the limitations on their authority. Although the new law did not void pre-existing Powers of Attorney, we have found that banks, Credit Unions, and financial institutions refuse to accept Powers of Attorney that do not contain that signed acknowledgment by the agents.

A Power of Attorney prepared before the new law became effective can be updated by attaching a POA Acknowledgment of Responsibilities, that is then dated and signed by each of your agents..

  1. Send us information about you, the Power of Attorney, and the names of the appointed Agents by clicking the “Submit Information Here” button.
